Jones had been working with the department for 17 years and had been eligible for captain for 12 years of those years. He even took the captain's test five times, and scored high on objective testing, but was "marked down in his verbal testing because he's African American," according to the lawsuit. The jury ultimately agreed he was discriminated against in 2012 but not 2014. The jury also declined to award punitive damages.

Sad part this happens all the time, but is rarely reported, when it needs to be. If you're ever discriminated against make sure you document everything and talk to an Attorney. Usually you can talk to an Attorney free of charge before you consider hiring them. Common work places that I know of that usually have the highest cases of discrimination are retail stores and police departments.
