
Dorika Uwimana has been in the hospital for the past 4 months due to
severe injuries after being brutally assaulted by Terry Wayne King II, a
white man, while she was on her way to school. Her injuries were so bad
that she needed a heart transplant, and it wasn’t until last week that
she finally received a new heart.
In April, Dorika was walking to a bus stop to go to Western Hills
Elementary School when a stranger approached her to ask for help. Then
suddenly, the stranger went to throw her to the ground and strangle her.
On Tuesday, July 17, police arrested Terry Wayne King II and he faces a
charge of injury to a child causing serious bodily injury.

King, who is a truck driver, had numerous criminal records before.
The police are investigating for more incidents. No motive for the
attack has yet been revealed.

It's pretty shocking that I am just hearing about this story early this morning. Thankfully Dorika Uwimana will make a full recovery given that there's no complications. The man who attacked her is in jail. My problem at this point is what he's charged with. Why was he not charged with attempted murder?
DEFINITION OF ATTEMPTED MURDER
In order for a person to be guilty of attempted murder, that person
should have deliberately, intentionally or recklessly with extreme
disregard for human life, attempted to kill someone. There should be
some substantial step towards committing the crime.
BREAK DOWN
Merely causing serious bodily harm or disfigurement to someone is
not sufficient to prove attempted murder unless there is evidence of
the actual intent to kill the person. For example, stabbing a person in
the arm, by itself, does not show an intent to kill, but stabbing or
shooting that person in the chest is more likely to satisfy the
requisite intent.
It is not necessary to have the specific intent to actually kill the
victim. The act of firing a gun into a residence and injuring a person
who is not the intended target meets the elements of attempted murder
because the offender showed an intent to kill by firing a firearm into
an inhabited building. You can abandon your intent to murder someone if
you do so before taking any direct step or action; deciding not to pay
someone to kill another person or disposing of the materials you bought with the intent to kill are indications of an abandonment of the intent.
The suspect in this case deliberately cut off this child airway to the point she suffered life threatening cardiac problems from lack of oxygen due to her being nearly strangled to death, so I really don't understand the charges. Now that I know about this story I will be keeping up with it as more news come out. I wish the best for Dorika and her family through this difficult time.
